Limited Power of Attorney

Limited Power of Attorney (POA) Usage Requirements
A Limited Power of Attorney may be used in a mortgage transaction only if all of the following conditions are satisfied:
The POA clearly references and applies solely to the specific transaction
It is officially recorded along with the Mortgage or Deed of Trust
The document includes a defined expiration date
The POA is used exclusively to sign final closing documents
The borrower who granted the POA must have personally signed the initial Uniform Residential Loan Application (URLA)
The designated attorney-in-fact cannot be an interested party, such as the seller, real estate agent, loan officer, or broker
Not allowed for use in cash-out refinance transactions
